User Terms of Service
By using the FuelMe-service, you (the User) agree to these Terms of Service. Please read the following Terms of Service carefully before using the FuelMe-service.
If you register as a company, association or any other legal entity, you represent and warrant that you are authorized to bind the entity into these Terms of Service.
1. Description of the FuelMe service
1.1. FuelMe provides a nutritious meal manufacturing and delivery service.
1.2. By choosing and purchasing products on the FuelMe-service, the User makes a binding order to purchase the products and services on the terms and conditions presented to the User on the FuelMe-service before placing the order.
1.3. FuelMe will prepare and deliver the products set out on the Order to the User.
1.4 The ordered meals will be delivered to the pick-up point chosen by the User on Monday and/or Wednesday before 13:00.
1.5. After the Order has been placed by the User, the Order can only be cancelled before the order deadline Thursday midnight. Once the order deadline has passed, you cannot withdraw or cancel an Order for products or delivery services. Prior to placing an Order for a product or service, you should carefully review your selection.
1.6 The User can also choose to subscribe to a fixed amount of meals every week. In such case, the amount due is automatically deducted from the User on the same day of the week the following week as the order was originally subscribed to.
1.7 If the User has subscribed to the FuelMe-service, the User has the possibility to cancel the order or skip a week of meals if the order is cancelled or a week skipped before the order deadline Thursday midnight.
2. User Accounts
2.1 The Users that have ordered meals without registering an account will be invited to register after successfully placing an order.
2.2 In order to use the subscription part of the FuelMe-service, the User must create a user account by following the registration instructions in the FuelMe-service. The FuelMe-service credentials are personal. The User shall ensure that any user account credentials and equivalent information required to access the user account of the User are kept confidential and used in a secure manner not accessible by third parties. A User can have only one user account.
2.3 Where it is suspected that any unauthorized person has become aware of a User’s user account credentials or has access to the user account of the User, the User shall immediately inform FuelMe thereof. The User shall be responsible for any use of the FuelMe Service and any activity under the user account of the User.
2.4 In order to use the FuelMe-services, you must submit valid credit card or other payment method information to FuelMe. You agree to pay for all purchases arising from your use of the FuelMe-services. You must keep your credit card and other payment information that you have submitted to your user account updated.
3. Payments
3.1. The User will pay the purchase price set out in the Order by using the payment functionality of the FuelMe-service. The User’s payment obligation shall arise upon placing an Order through the FuelMe-service and the payment will be automatically charged from the User’s credit card or utilizing the payment method chosen by the User.
4. FuelMe-discounts and referral program
4.1. The Users of the FuelMe-service can obtain FuelMe-discounts e.g. by inviting new users to sign up to the FuelMe-service.
4.2. FuelMe may unilaterally determine the conditions applicable to the granting, use and validity of the FuelMe-discounts.
4.3. Any signing-up discounts can be used only once.
4.4. FuelMe-discounts cannot be exchanged to cash.
4.5. The FuelMe-discounts will be nullified if FuelMe detects any abuse of FuelMe-discounts or suspects or detects that FuelMe-discounts have been granted on incorrect grounds. In such cases, FuelMe shall invoice the amount that was paid using such FuelMe-discounts.
5. Delivery of an Order
5.1. The Order will be delivered to the delivery point chosen by the User on the FuelMe-service. Possible deliveries ordered through third-party delivery services will be done using the terms & conditions provided by the respective third parties.
5.2. The delivery fridges of FuelMe are on principle unlocked. FuelMe has strived to have delivery points that are as safe and secure as possible.
5.3. The User must collect their order from the delivery point on the date of delivery or during the day immediately following the date of delivery. After this the delivery point is emptied on behalf of FuelMe and there will be no compensation for undelivered orders.
5.4. If you are unable to find your order at the delivery point, please contact FuelMe immediately so that we can look into the matter and arrange a new delivery, if necessary.
6. Intellectual Property Rights
6.1 All Intellectual Property Rights in or related to the FuelMe-service and thereto related documentation and all parts and copies thereof shall remain exclusively vested with and be the sole and exclusive property of FuelMe and/or its subcontractors/licensors. “Intellectual Property Rights” shall mean copyrights and related rights (including database and catalogue rights and photography rights), patents, utility models, design rights, trademarks, tradenames, trade secrets, know-how and any other form of registered or unregistered intellectual property rights.
6.2 These Terms of Service do not grant the User any Intellectual Property Rights in the FuelMe-service.
7. Additional Provisions for use of the FuelMe-service
7.1 The FuelMe-service is only available to persons of the age of 18 years or older.
7.2 We are constantly developing the FuelMe-service and we may change or remove different parts of the FuelMe-service, including features, the products available in the FuelMe-service in part or in whole.
7.3 The User will not: (i) use or attempt to use another person’s FuelMe account and/or access another person’s payment data on the FuelMe-service or use another person’s payment cards when using the FuelMe-service, without consent of that other person; (ii) copy, modify or create derivative works of the FuelMe-service or any related technology; (iii) reverse engineer, decompile, disassemble, decipher or otherwise attempt to derive the source code for the FuelMe-services or any related technology, or any part thereof; (iv) remove any copyright, trademark or other proprietary rights notices contained in or on the FuelMe-service; (iv) remove, cover or obscure any advertisement included on the FuelMe-service; (v) collect, use, copy, or transfer any information obtained from the FuelMe-service without the consent of FuelMe; (vi) use bots or other automated methods to use the FuelMe-service; (vii) create a FuelMe account using a fake identity or an identity of another person; and (viii) access the FuelMe-service except through the interfaces expressly provided by FuelMe.
7.4 FuelMe is entitled to remove a User from the FuelMe-service with immediate effect and/or refuse or cancel any Orders from a User if (i) the User abuses the FuelMe-service or causes any harm or detriment to the use of the FuelMe-service and/or FuelMe, (ii) the User places a false Order or otherwise fails to comply with his obligations arising from these Terms of Service; (iii) if there is reasonable doubt about the correctness or authenticity of the Order. If FuelMe cancels an Order that has already been paid for, FuelMe shall transfer that amount into the same account as the one from which the payment was made by the User.
7.5 The controller of the personal data collected about Users is FuelMe Oy, unless otherwise indicated. FuelMe Oy shall process any personal data collected from the User in accordance with its Privacy Statement.
8. Term and termination
8.1 These Terms of Service are in force as a binding agreement until further notice as long as the User is using the FuelMe-service.
8.2 The user can discontinue the use of the FuelMe-service at any time. FuelMe can discontinue providing the FuelMe-service permanently or temporarily at any time.
9. Limitation of Liability
9.1 The following section is only applicable to non-consumer Users of the FuelMe-service: Under no circumstances shall FuelMe be liable to the User for any indirect damages, including lost profits, lost sales or business, lost data or business interruption, or for any direct damages in excess of the amounts actually retained by FuelMe from the User in the three (3) months preceding the event giving rise to the claim.
10. Complaints
10.1 Please note that the FuelMe-service may at any time be interrupted or permanently discontinued. The FuelMe-service may also be temporarily suspended.
10.2 If there are any defects in the (delivery of the) Order, the User must submit any complaints to FuelMe without delay, with clear descriptions of said shortcomings to the customer service of FuelMe through the customer support chat or at info@fuelme.fi.
11. Applicable Law and Dispute Resolution
11.1 These Terms of Service shall be governed by and shall be construed in accordance with the laws of Finland. If you are a consumer domiciled in the EU, please note that you cannot be deprived of the rights granted to you by the mandatory consumer protection laws of your country of domicile. Disputes arising from these Terms of Service shall be resolved by the district court of Helsinki. A consumer may always institute proceedings in the district court of its domicile. Parties may also use the ODR platform managed by the European Commission to settle their disputes. This platform can be found on http://ec.europa.eu/odr. As a Finnish consumer, you may always refer a dispute to the Finnish Consumer Disputes Board (please see kuluttajariita.fi and kuluttajaneuvonta.fi for instructions).
12. Amendments
12.1 These FuelMe Terms of Service are subject to amendments.
12.2 FuelMe shall publish the amended FuelMe Terms of Service at the FuelMe Website and shall inform the User that the FuelMe Terms of Service have been amended on the FuelMe-service or by email to the email address submitted to the FuelMe-service by the User. If the User does not agree to any amended FuelMe Terms of Service, he/she shall discontinue the use of the FuelMe-service.
13. Assignment
13.1 FuelMe shall be entitled to assign all or any of its rights or obligations hereunder in whole or part to an affiliate or successor or to a purchaser or acquirer of its business assets relating to FuelMe-service without the User’s prior consent.
13.2 The User shall not be entitled to assign any of its rights or obligations hereunder in whole or part.
